1. Who We Are and What This Policy Covers

536 Single RE, LLC, a Florida limited liability company ("Soleta," "we," "us," or "our"), owns and operates Soleta Golf Club and the residential community marketed as Soleta Residences at 33720 Singletary Road, Myakka City, Florida 34251.

This Privacy Policy describes how we collect, use, disclose and retain information in connection with:

  • soletagolf.com, the Soleta Golf Club and Soleta Residences website;
  • any landing page, digital advertisement, listing, email, text message, form or online tool we operate that links to this Policy; and
  • inquiries you submit to us through those channels.

We refer to these collectively as the "Sites."

What this Policy does not cover. Club member account systems, point-of-sale and tee-time platforms, payment processors, and the websites of our Designated Builders, cooperating brokers and real estate listing portals are operated by third parties under their own privacy notices. Information you provide directly to those parties is governed by their notices, not this one.

2. The Short Version

We collect the information you give us when you inquire about a homesite, a residence plan, club membership or an event, together with information about how you use the Sites. We use it to respond to you, to show you the homesites and plans most likely to suit you, to send you information you have asked for, and to measure our advertising. We share it with the service providers who operate our systems on our behalf, and — where you ask us to or where your purchase requires it — with a Designated Builder, a cooperating broker, or the parties to your transaction. We do not sell your information for money. You can ask us to stop contacting you at any time, and we will honor that request permanently.

The sections that follow explain each of these points in detail.

3. Information We Collect

3.1 Information you provide to us

Identity and contact information. Name, email address, telephone number, mailing address, and your preferred method and time of contact.

Household and relationship information. The name and contact details of a spouse, partner, family member or co-purchaser when you provide them, or when that person contacts us about the same property. We may link the records of people we understand to be part of the same household so that we treat one household as a single inquiry rather than two.

Inquiry content. The homesite, homesite type, residence plan or membership category you ask about; your indicated timing, intended use and general requirements; and the content of any message, question or note you send us.

Preferences and interests. The collections, plans, amenities or aspects of the community you tell us matter to you, and any preferences you set for how we contact you.

Visit and event information. Details relating to a site visit, tour, club visit or event, including the date, the party attending and any accommodation you request.

Membership list and waitlist information. Information submitted when you ask to be added to a membership list or waitlist. Where a deposit is required, payment is processed by a third-party payment processor; we do not receive or store full payment card numbers.

Transaction information. If you proceed toward a purchase, we and our closing, lending, title and builder counterparties collect further information — including identity verification and financial information — through the purchase, membership and construction documents. That information is collected principally offline and is governed by those agreements and by applicable law in addition to this Policy.

Correspondence. Emails, text messages, form submissions, voicemails and notes of conversations with our sales and membership teams.

Employment and vendor inquiries. Information you submit when applying for a position or offering goods or services.

3.2 Information collected automatically

When you use the Sites, we and our analytics and advertising providers collect:

Device and connection data. IP address, approximate location derived from IP address, device type, operating system, browser, screen size and language.

Usage data. Pages and screens viewed, time spent, referring website, the search terms or advertisement that brought you to us, and campaign parameters appended to links (for example UTM values).

Interaction data specific to our residential site. Which homesites you select on the interactive map, which homesite types and residence plans you view, floor plans you open or download, plans you place side by side in the comparison tool, and links you share.

Pre-identification activity. We assign an identifier to your browsing session before we know who you are. If you later submit a form or click through from one of our emails, we may associate that earlier activity with your record so that we understand what you were looking at before you contacted us. If you never identify yourself, that session data remains unassociated.

Message engagement. Whether an email we send is delivered, opened or clicked, and whether a text message is delivered or fails.

Section 5 explains the cookies and similar technologies used to collect this information and how to control them.

3.3 Information we receive from others

Real estate portals and listing services. When you submit an inquiry through Zillow, Realtor.com, Redfin, an MLS or a similar service, that service forwards your inquiry and contact details to us.

Designated Builders and cooperating brokers. A builder or a broker representing you may share your contact and requirement information with us in the ordinary course of a shared prospect or transaction.

Advertising and analytics platforms. Aggregated and de-identified measurement, audience and attribution information from providers such as Google and Meta.

Referrals. Information provided by an existing member, resident or acquaintance who refers you, and information you provide about someone you refer to us. If you give us someone else’s contact information, please make sure they are comfortable with that.

Club operations. Where a residential purchase results in membership activation, limited information is exchanged between our residential and club functions for that purpose. We do not import club member records into our residential sales pipeline.

4. How We Use Information

We use the information described above to:

  • respond to your inquiry and provide the materials, pricing, plans or introductions you request;
  • understand what you are looking for and show you the homesites, homesite types and residence plans most likely to suit it;
  • arrange and follow up on visits, tours, appointments and events;
  • administer membership lists, waitlists and membership activation;
  • send you information about Soleta, including availability, plans, construction progress, club news and events, where you have agreed to receive it;
  • operate, secure, troubleshoot and improve the Sites and our systems;
  • measure the performance of our marketing, including which channels and campaigns produce genuine interest;
  • maintain records of consent, communications and transactions;
  • comply with law, respond to lawful requests, and establish, exercise or defend legal claims; and
  • evaluate, negotiate or complete a corporate transaction, as described in Section 7.

A purchase at Soleta typically unfolds over many months. We retain and use your information across that period so that a conversation you began last season does not have to start over, and so that you are not contacted twice about the same thing by two parts of our team.

5. Cookies, Analytics and Advertising Technologies

We use cookies, pixels, tags, local storage and similar technologies for four purposes:

Strictly necessary. Security, session management, load balancing, fraud prevention and remembering choices you make on a form. These cannot be switched off through our Sites.

Analytics. Understanding how the Sites are used and where visitors encounter difficulty. We use Google Analytics and Replit-hosted analytics to measure visits, pages viewed, traffic sources, device information and interactions such as homesite views and inquiry submissions. Analytics may use cookies, browser storage and similar identifiers. For Google's data practices, see How Google uses information from sites that use its services.

Session recordings. We use Microsoft Clarity to understand interactions with our public website through heatmaps and session recordings. Clarity may process interaction, device and usage information. We send denied signals for both analytics and advertising storage and use its limited no-consent mode, which does not use cookies to persist session data. This does not mean no data is collected: measurement is limited, with a separate identifier for each page view rather than cookie-based cross-session identification. Inquiry form content is masked, and Clarity is excluded from CRM and private pages. You can opt out using the session recording preference below. We also disable Clarity when your browser sends a Global Privacy Control or Do Not Track signal. These controls apply to Clarity only, not Google or Meta tracking. Advertising and measurement. Measuring the results of our advertising and, where enabled, showing Soleta advertising to you on other platforms. These technologies are provided by advertising platforms including Google and Meta.

Google Ads tags and the Meta Pixel may collect information about page visits, browser and device identifiers, interactions and completed inquiry events to attribute advertising results. We also retain campaign parameters and advertising click identifiers with inquiries to understand which campaigns generated interest. These technologies may use cookies or similar storage and send event information to the relevant provider. See the Google Privacy Policy and Meta Privacy Policy for their data practices.

Preferences. Remembering settings such as your consent choices and display preferences.

You can control cookies through your browser settings, and you can opt out of Google Analytics using the browser add-on Google provides. Blocking some cookies will affect how parts of the Sites function. Where we deploy advertising technologies that constitute "targeted advertising" or "sharing" under applicable state law, Section 11 explains how to opt out.

6. Email, Telephone and Text Message Communications

6.1 How consent works

We keep a record of the consent you give us — what you agreed to, when, and through which form or channel. Leaving a consent box unchecked on a later form does not withdraw consent you gave earlier; it simply means no new consent was given at that moment. Consent is withdrawn only when you tell us to stop, through any of the methods below.

6.2 Email

Marketing emails include an unsubscribe link in every message. Unsubscribing takes effect promptly and permanently. We may still send you transactional messages relating to an inquiry you have made, a visit you have scheduled or a transaction in progress.

6.3 Text messages

Where you have agreed to receive them, we may send text messages about your inquiry, your visit, or homesites and plans that match your stated interests.

  • Consent to receive marketing text messages is not a condition of purchasing any property, membership or service.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to any message to stop all further marketing texts; reply HELP for assistance.
  • Carriers are not liable for delayed or undelivered messages.
  • We do not sell or share mobile telephone numbers with third parties for their own marketing.

6.4 Telephone calls

We may call you at a number you provide in order to respond to your inquiry, and, where you have given prior express written consent, to tell you about homesites, residences, membership and events. You may ask us to stop calling at any time and we will honor that request. We maintain an internal do-not-call list and observe federal and state do-not-call registries as required by law.

6.5 Sharing a homesite or plan by text

Our residential site lets you send a link to a homesite or residence plan using your own device’s messaging application. That message is sent by you, from your device. We do not receive the recipient’s telephone number and do not add the recipient to any list.

6.6 Suppression

When you opt out, we add you to a permanent suppression list. That list exists so that your request is honored even if your details reach us again from another source, and it is not overridden by any campaign or sequence.

7. How We Share Information

We share information in the following circumstances, and not otherwise:

Service providers. Companies that host our systems, deliver our email and text messages, provide analytics, process payments, and support our sales, marketing and club operations. They act on our instructions and are not permitted to use your information for their own purposes.

Designated Builders. Every residence at Soleta is built by a Designated Builder. Where you ask to be introduced to a builder, request builder pricing or plan information, or move toward a build, we share the information necessary for that purpose. Designated Builders are independent companies and use your information under their own privacy practices.

Cooperating brokers. Where a licensed real estate broker represents you or brings your inquiry to us, we share information as necessary to work with that broker.

Transaction participants. Title companies, closing agents, lenders, surveyors, attorneys and homeowners or community associations, as required to complete and record a purchase.

Club operations. Where a purchase gives rise to club membership, the information needed to activate and administer that membership.

Professional advisors. Our attorneys, accountants, auditors and insurers.

Investors and lenders. Aggregate and de-identified performance information — for example, inquiry volumes, absorption and channel performance. We do not provide individual contact records for this purpose.

Legal and safety. Where required by law, subpoena or regulatory request; to enforce our agreements; or to protect the rights, property or safety of Soleta, our members, residents, guests or the public.

Corporate transactions. In connection with a financing, merger, sale of assets or similar transaction, subject to appropriate confidentiality protections.

We do not sell your personal information for money. Some state privacy laws define "sale" or "sharing" broadly enough to include the use of advertising cookies that pass identifiers to advertising platforms. To the extent we use such technologies, we treat that use as "targeted advertising" and provide the opt-out described in Section 11.

8. How Long We Keep Information

We keep information for as long as it serves the purpose for which it was collected, and then for as long as we need it for legal, tax, accounting or dispute-resolution purposes.

Inquiries and sales records. Retained through the sales cycle and for a period afterward, given that interest at Soleta commonly develops over one to two years or longer, and that a homesite purchase carries long-tail legal and warranty considerations.

Consent and communication records. Retained for as long as necessary to evidence compliance with telemarketing, email and privacy law.

Suppression records. Retained indefinitely, because deleting them would defeat the opt-out they exist to enforce.

Analytics data. Retained in accordance with the retention settings of our analytics platform.

Where you ask us to delete your information, we will do so subject to the exceptions described in Section 11.

9. Security

We maintain administrative, technical and physical safeguards designed to protect information against loss, misuse and unauthorized access — including encrypted transmission, role-based access to our systems, authentication controls, audit logging of changes to records, and regular backups. No system is perfectly secure, and we cannot guarantee the security of information transmitted over the internet. If we become aware of a breach affecting your information, we will notify you and any regulator as required by applicable law.

10. Children

The Sites are intended for adults. They are not directed to children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has provided us with personal information, contact us using the details in Section 15 and we will delete it.

11. Your Choices and Rights

11.1 Choices available to everyone

  • Unsubscribe from marketing email using the link in any message.
  • Reply STOP to any marketing text message.
  • Ask us to update or correct your contact details or your stated preferences.
  • Ask us to stop contacting you altogether.
  • Control cookies through your browser and opt out of analytics as described in Section 5.

11.2 State privacy rights

Residents of a number of U.S. states have rights to confirm whether we process their personal data, to access a copy of it, to correct inaccuracies, to request deletion, to obtain a portable copy, and to opt out of targeted advertising, the sale of personal data and certain profiling. Some states also give consumers the right to appeal a refused request.

Whether these laws apply to us depends on thresholds set by each statute. As a matter of policy, we will honor verifiable requests of this kind from any resident of the United States, whether or not we are legally required to do so.

11.3 How to make a request

Submit a request using the contact details in Section 15. We will acknowledge it, take reasonable steps to verify your identity — which may include confirming information we already hold — and respond within the period required by applicable law. An authorized agent may make a request on your behalf with written authorization.

We may decline a request in whole or in part where the law permits, for example where we must retain information to complete a transaction, to comply with a legal obligation, to detect fraud, or to establish or defend a legal claim. If we decline, we will tell you why and how to appeal.

11.4 No discrimination

We will not deny you goods or services, charge you a different price, or provide you a different level of service because you exercised a privacy right.

11.5 Do Not Track and Global Privacy Control

Browsers and devices vary in how they signal tracking preferences, and there is no common industry standard for "Do Not Track." Where applicable law requires it, we treat a browser-based opt-out preference signal, such as Global Privacy Control, as a request to opt out of targeted advertising for that browser or device.

12. Third-Party Websites and Listings

The Sites link to and are linked from other websites, including our club and residential sites, Designated Builder websites, real estate portals and social media platforms. We are not responsible for the privacy practices or content of any website we do not operate. Review the privacy notice of any site you visit.

13. Visitors Outside the United States

Soleta is located in Florida and our systems are operated in the United States. If you contact us from outside the United States, your information will be transferred to and processed in the United States, where privacy law differs from that of your home country.

14. Changes to This Policy

We may update this Policy from time to time. When we do, we will change the "Last Updated" date above and post the revised Policy on the Sites. If the change is material, we will provide more prominent notice. Continuing to use the Sites after a change takes effect means you accept the revised Policy.
